Sommaire :
The fact that thieves, without incidents of the same nature having occurred before, have, thwarting the protection of access to the entire parking area, broken into the enclosure and that they have stolen the load awaiting departure for France, characterize the exceptional circumstances that the carrier could not avoid. Pursuant to Article 17.2 of the CMR, the carrier is exempt from liability.
