Abstract:
Domage for delay in the sense of article 23§5 CMR in concurrence with damages to goods in the sense of article 23§1 CMT which occurred separately and without any causal connection between both samages, is cumulatively eligible for indemnification on top of the indemnity fot domages, is cumulatively eligible for indemnification on top of the indemnity for damages to or shortage of the transported goods.

Under the CMR regime, to the extent that under article 13§1 CMR in relation to claims for damage, shortage or delay in delivery under article 17 CMR, in addition to the sender, the consignee is also entitled to claim, there is, in their relationship to the carrier, a co-creditorship whereby the sender may, at his discretion, demand compensation to himself or to the consignee.
