Sommaire :
The arbitration clause included in the carrier's T & Cs renders ordinary state courts incompetent to hear claims falling within its field but, as long as the arbitral tribunal is not constituted, it cannot, in the event of a noted urgency, defeat the exercise of the powers of the summary proceedings court. The provision for interim relief therefore remains exceptionally open, but it is then subject to the condition of urgency.
