Objet :
International road transport on behalf of a flower and plant wholesaler (Netherlands / France) - Unpaid carrier - Interim action for interim relief (yes) - Jurisdiction - Applicability of the arbitration clause included in the carrier's T & Cs (yes) - Article 33 of the CMR - Article 39 of the CMR - Referral prior to the constitution of the arbitral tribunal
Sommaire :
The arbitration clause included in the carrier's T & Cs renders ordinary state courts incompetent to hear claims falling within its field but, as long as the arbitral tribunal is not constituted, it cannot, in the event of a noted urgency, defeat the exercise of the powers of the summary proceedings court. The provision for interim relief therefore remains exceptionally open, but it is then subject to the condition of urgency.
