Sommaire :
Articles 17-4 and 18 of the CMR in any event provide for certain specific risks for which the carrier is not liable. In application of these texts in fact, the carrier is released from liability when he establishes, which is not disputed in this case, that the damage results from the unloading of the goods by the sender, the recipient, or persons acting on behalf of the sender or recipient.
