Transport of an application for tender between France and Belgium - Delay - Rejection of the application - Liability of the carrier (yes) -

Sommaire :
1) The damage occurred during the delivery of the package after a land transport between France and Belgium, the application of the CMR by the Court of Appeal is legally justified.

2) It cannot be deduced, neither from the delay in delivery, nor from the absence of a request for a subsequent instruction during the delivery, the proof of inexcusable fault defined in article L. 133-8 of the referred commercial code. in Article 29 of the CMR.

3) The contractual clause exempting the carrier from any liability for delay is void because it is prohibited by Articles 41 para. 1 and 23 al. 5 of the Geneva Convention.
