Sommaire :
The Austrian operator having chartered, via a freight exchange, the valet is not a freight forwarder but a transporter as evidenced by his registration form.
For international transport (Italy / France), the CMR is applied. Under article 3, in the event of subcontracting, the carrier is responsible for its substitutes. Pursuant to article 32 of the CMR, the limitation period is from one year to three years, in the case of fraud or misconduct considered, according to the law of the court seized, as equivalent to fraud. The diversion, by the carrier, of the goods which it is responsible for transporting characterizing an intentional fault of causing damage to others, constitutes fraud. The limitation period for the action brought is therefore three years, regardless of the definition given by French law, of equipollent fault in fraud, since fraud, provided for by CMR and existing in French law, is in characterized species. The action is not prescribed.
